Queen Creek Personal Injury and Wrongful Death Lawyer for Car, Bicycle and Pedestrian Crashes

Experienced Personal Injury Lawyer | Former Insurance Adjuster & Defense Attorney

In 2023, Queen Creek recorded 491 vehicle crashes across its rapidly expanding network of wide and high-speed roadways and highways. The intersection of Rittenhouse Road and Ocotillo Road stands out as the city’s highest-frequency crash location, with 72 crashes recorded between 2018 and 2023. Other high-crash intersections include Ellsworth Road and Queen Creek Road (43 crashes), South Ellsworth Loop Road and Rittenhouse Road (40 crashes), and Empire Boulevard and Ellsworth Road (34 crashes). Add commuter traffic from LG Energy Solution’s $5.5 billion advanced battery manufacturing campus and heavy retail and shopping traffic at SanTan Village, Queen Creek Marketplace, and Vineyard Towne Center, and Queen Creek’s growth-driven road network carries more crash risk with each passing year. Treatment for injuries sustained in Queen Creek vehicle crashes often runs through Banner Ironwood Medical Center on North Gantzel Road.

Licensed with the State Bar of Arizona since 2006, I use my insurance adjuster and defense attorney background to help injured Queen Creek residents pursue fair and reasonable compensation. I keep a manageable caseload so you work directly with me, and not a case manager, from the first call to the final resolution.

For a free and confidential personal injury consultation and case evaluation, schedule a convenient time.

Why I Handle Queen Creek Crash Cases Differently

I keep my caseload manageable so every case gets my direct attention. I work directly with the client from intake, set up regular status calls during the treatment phase, demand letter preparation, settlement negotiations, and litigation if necessary. I also promptly respond to client questions and offer transparency throughout the process.

Large personal injury firms in the Phoenix metro handle thousands of cases at a time. At that volume, clients are typically assigned to case managers or paralegals to manage the client experience. You may hire an attorney, see them briefly at signing, and then spend the next year talking to staff.  Different business model.

I am a former insurance claims adjuster and a former insurance defense attorney. I have sat on the other side of the table evaluating claims, identifying weaknesses, creating defense strategies and negotiating settlements to help insurance companies minimize their exposure. I now use that same knowledge gained from my insurance background exclusively on behalf of injury victims in Queen Creek and the East Valley.

That combination of insurance background and experience, along with personal attention from a detail-oriented lawyer creates a fundamentally different experience for clients navigating a difficult chapter of their lives. It also makes a real difference in how cases are evaluated and resolved.

Queen Creek’s Most Dangerous Intersections and Crash Corridors

Rittenhouse Road & Ocotillo Road (Queen Creek’s Most Crash-Prone Intersection)

Rittenhouse Road and Ocotillo Road recorded 72 crashes between 2018 and 2023, making it Queen Creek’s highest-frequency crash location. The intersection sits at a convergence of residential growth corridors, commercial traffic, and commuter routes serving the southern portions of the city. Wide lanes and high posted speeds create conditions where vehicles moving in multiple directions generate frequent and serious vehicle crashes. As Queen Creek continues to develop around this corridor, crash frequency at this intersection is likely to stay the same or even increase.

Ellsworth Road & Queen Creek Road

The Ellsworth Road and Queen Creek Road intersection has recorded 43 crashes, reflecting the heavy two-directional traffic flows that define this busy crossing. Ellsworth Road is one of Queen Creek’s primary north-south roadways, carrying commuter traffic to and from the broader East Valley. The intersection’s proximity to retail development and residential density creates consistent vehicle conflicts, particularly during peak morning and evening rush hours.

South Ellsworth Loop Road & Rittenhouse Road

With 40 crashes recorded during the same five-year period, the South Ellsworth Loop Road and Rittenhouse Road intersection has experienced a significant volume of vehicle crashes along one of Queen Creek’s busiest routes. The road layout and heavy traffic from Queen Creek Marketplace and surrounding neighborhoods are primary factors in why crashes routinely occur at this intersection.

Empire Boulevard & Ellsworth Road

Empire Boulevard and Ellsworth Road has recorded 34 crashes and marks the point where Hunt Highway transitions to Empire Boulevard, funneling traffic from the west into one of Queen Creek’s busiest intersections. Drivers heading to San Tan Regional Park for hiking and mountain biking and commuters passing through to the growing San Tan Valley communities converge here, creating a sustained mix of recreational and through-traffic at high speeds that explains why this intersection consistently experiences vehicle crashes.

SR-24 (Gateway Freeway) Corridor

State Route 24, known as the Gateway Freeway, is a five-mile corridor connecting Loop 202 in Mesa to Ironwood Drive at the edge of Queen Creek’s residential communities. The route provides direct access to Mesa Gateway Airport and the Arizona Athletic Grounds multi-sport complex, drawing a consistent mix of commuter and destination traffic onto a freeway that is still under active construction. Ongoing construction has created lane shifts, altered interchange geometry, and elevated crash exposure at on- and off-ramps, where drivers encounter changing conditions with little warning. Crashes on SR-24 typically involve higher speeds and more severe injury outcomes than intersection crashes elsewhere in Queen Creek.

Loop 202 (Santan Freeway) Corridor

The Loop 202 Santan Freeway forms a northern boundary for much of Queen Creek’s development and carries heavy commuter traffic connecting the city to the East Valley communities of Gilbert, Chandler, Apache Junction, and Mesa, as well as the greater Phoenix metro. High speeds, heavy traffic volume, and the constant flow of vehicles entering and exiting the 202 create consistent crash exposure for Queen Creek motorists using the freeway to reach employment and shopping centers across the East Valley.

Crashes occurring on Queen Creek freeways and major intersections range from fatal and serious injuries, including traumatic brain injuries, fractures, debilitating neck and back and other life altering injuries.

Emergency and Trauma Care for Queen Creek Crash Victims

Medical facilities serving motorists injured on Queen Creek’s roadways, intersections, and freeways include:

Banner Ironwood Medical Center

Banner Ironwood is a full-service Level III trauma center on North Gantzel Road in Queen Creek, positioned along the SR-24 and Gantzel Road corridors that carry the city’s highest traffic volumes. The 78-acre campus includes a 24-hour emergency department and serves as a base for a BannerAir helicopter. A planned 30,000 square foot expansion on the north side of the hospital will add 10,000 square feet to the emergency department, a new operating room suite, 34 additional beds, and 80 new parking spaces, with completion targeted for early 2027. The campus is designed to eventually grow to more than 500 beds as Queen Creek and surrounding communities continue to expand.

Other hospitals serving the broader region include Dignity Health Mercy Gilbert and Banner Gateway Medical Center, both in Gilbert.

For crashes with less serious injuries, Gateway Urgent Care and Alliance Urgent Care offer same-day evaluation and injury triage without a full emergency room visit.

For specialized follow-up care, Banner Health Center at South Ellsworth Loop in Queen Creek provides sports medicine services including concussion evaluation through certified ImPACT providers, as well as orthopedic care for fractures and musculoskeletal injuries common in vehicle crashes.

Why Early ER Evaluation Matters for Your Claim

Even if you feel fine at the scene following a Queen Creek vehicle crash, it is very common to begin experiencing pain and symptoms once you are home and the adrenaline has worn off. Prompt medical evaluation is critical not only for your health, but for documenting your personal injury claim. Gaps in time between the crash and the start of treatment give insurers ammunition to argue that your injuries were caused by something other than the vehicle crash. Being evaluated immediately creates a documented record of your condition from the start.

What You Can Expect When You Work With Me

Hiring me creates a buffer between you and the insurance company, leveraging my personal injury experience and insurance adjuster/defense background while keeping your case moving. I build up and present claims the way insurance companies evaluate them, and I negotiate with adjusters and defense counsel, including filing lawsuits when warranted, to maximize the likelihood of you receiving fair and reasonable compensation.

Process: The personal injury claim process can be long, daunting, and full of pitfalls. When fault or liability is unclear, I conduct targeted fact-gathering and, when appropriate, retain a licensed private investigator to preserve work-product protection. I obtain and analyze medical records and itemized billing, then prepare a well-documented, persuasive demand for insurer review. I negotiate with the carrier to pursue fair, reasonable compensation and, when necessary, file suit to achieve that objective. I also identify and negotiate healthcare provider liens and medical subrogation claims.

Communication: I keep a manageable caseload so clients have direct access to me rather than working solely through staff. You will not spend months leaving voicemails for a case manager who is juggling hundreds of files. You have my direct number, and when something changes in your case, you hear it from me first. You receive the attention and updates needed to stay informed about the claims process. I collaborate with you throughout, explaining options and timing so you can make well-informed decisions at every stage.

Value: As a former insurance adjuster and defense lawyer, I realistically evaluate each case and use practical, creative strategies to pursue fair and reasonable compensation. My caseload stays manageable by design because the quality of my representation and the outcomes I achieve for clients matter more than volume.

How My Insurance Background Adds Value to Your Queen Creek Case

When an insurance adjuster picks up your file, they are reading it with one goal in mind: how to pay as little on the claim as possible. Adjusters look for perceived weaknesses, including gaps in treatment, pre-existing conditions, inconsistencies, and overreaching, to argue and justify lowball offers. Adjusters at carriers like State Farm, GEICO, Allstate, Progressive, and others evaluate Queen Creek crash claims with that same goal in mind.

Claims have to be presented with the diligence and detail necessary to persuade the adjuster that I’m not a lazy personal injury attorney looking to churn the file as quickly as possible. I keep my caseload manageable precisely so that I can build the case up the right way, maintain communication with the client, and then present the client’s demand with the detail necessary to try to achieve fair and reasonable compensation whether before or during litigation.

Inside the Adjuster’s Evaluation Process

Understanding how insurance companies and adjusters analyze and evaluate claims is an underrated advantage in representing personal injury clients. Insurance adjusters are not simply reviewing your medical bills and blindly writing a check for whatever amount you demand. They are evaluating your file, assessing the potential jury verdict based on alleged damages and venue, and then creating settlement ranges. Initial offers are low because they want to test who is willing to put in the work, and the pressure to pay fair and reasonable compensation does not yet exist.

Insurance companies and adjusters carefully scrutinize whether your mechanism of injury is capable of causing the alleged injuries and symptoms. They review prior medical history, treatment gaps, and inconsistencies that give them the opportunity to unravel the claim and resolve it for a low settlement. They evaluate how the claimant or plaintiff presents, including attributes like demeanor, defensiveness, straightforwardness or evasiveness, and whether the person is sympathetic or clearly overreaching. This reality shapes settlement value ranges and settlement negotiations throughout the process.

I spent years evaluating claims from that perspective and now I use those same skills to represent clients injured in Queen Creek during the personal injury claims process and litigation.

Find the Right Personal Injury Lawyer to Represent You in Queen Creek

The attorney-client relationship is about fit. What the client looks for in hiring a lawyer depends on what that client values and expects during the representation. For some, these values and expectations include:

Background and Competence

A capable personal injury lawyer has the background, skills, and experience to spot the legal and factual issues that drive value and to build the case the way insurance companies evaluate claims. Being unrealistic and overreaching can undermine credibility and ultimately sabotage the case. The goal of every personal injury claim is to secure fair and reasonable compensation for the client’s injuries from the at-fault party or parties. This is what Arizona law allows.

Personal Fit, Empathy and Direct Access

Sustaining a personal injury brings stress and uncertainty. At a large-volume firm, clients can be surprised to discover that the attorney they hired is largely unavailable and that their primary contact is a case manager or paralegal who may be juggling hundreds of files. Ensuring you will have real access to your lawyer is as important as evaluating their credentials. Clients deserve empathy, responsiveness, and direct access with clear, transparent explanations, realistic timelines, and steady updates so they can make well-informed decisions along the way.

Practical and Creative Problem-Solving

Navigating the personal injury claims process blends practical solutions with creative, out-of-the-box problem solving. The aim is to keep the case on track with claims supported by evidence and a plausible mechanism of injury, while also identifying areas to develop further to strengthen persuasion so insurers are pressed to offer fair and reasonable compensation rather than relying on flimsy evaluations and maintaining lowball offers.

Honesty, Objectivity and Willingness to Fight

Clients deserve honest, transparent, and objective evaluations at every stage, with the client’s needs placed above the lawyer’s. A good personal injury lawyer negotiates firmly to pursue fair and reasonable compensation and is willing to litigate when offers are unfair or unrealistic.

Frequently Asked Questions

How long do I have to file a personal injury claim in Arizona?

In Arizona, the statute of limitations for most personal injury claims is two years from the date of injury under A.R.S. § 12-542. This means you must settle your claim or file a lawsuit against the at-fault party before that two-year window closes.

There is an important exception for certain individuals. If the injured person is under 18 years old, or is of unsound mind at the time the injury occurs, the two-year clock does not start running until that disability is removed. This means that once the injured individual turns 18 or regains mental capacity, under A.R.S. § 12-502, this individual is entitled to the same two year period after their disability ends as anyone else would have from the date of injury.

Regardless of whether an exception may apply to your situation, it is always best to speak with a personal injury attorney as soon as possible. Evidence fades, witnesses become harder to locate, and the earlier your attorney gets involved, the stronger your case will be.

How much does a personal injury attorney cost in Queen Creek?

Paul Ticen Law handles personal injury cases on a contingency fee basis, which means you pay no attorney fees unless we recover compensation for you. There is no upfront cost, the firm advances all litigation costs, and there is no fee for your initial consultation.

What should I do after a car accident in Queen Creek?

After a car accident in Queen Creek, you should take the following steps:

Call 911 and stay at the scene. Do not leave until law enforcement has responded and a report has been filed.

Document the scene. Take photos of all vehicles involved, skid marks, roadway markings, and nearby landmarks before anything is moved or cleared. Unfortunately there are situations where the police were not called or the police did not respond to the scene.  If this occurs, it is critical to make sure you take a picture of the other driver’s license information, proof of insurance card, the other vehicle’s license plate number and VIN number, before leaving the scene.

Seek medical attention as soon as possible. Even if you feel fine at the crash scene, it is very common to begin experiencing pain and symptoms once you’re back home and the adrenaline has worn off. It is critical to get prompt treatment so that your pain, symptoms, and the history of how they developed are properly documented. Gaps in time between the crash and the start of treatment create unnecessary causation issues, which means the insurance company will argue your injuries were caused by something other than the motor vehicle crash.

Report the accident to your insurance company, even if you were not at fault. Most policies require timely reporting as a condition of coverage.

Contact a personal injury attorney before giving any recorded statements to the other driver’s insurer. A consultation will also help you determine whether an attorney will add value to your case and whether he or she is the right fit for your particular situation.

How much is my personal injury case worth in Arizona?

Under Arizona law, an injured individual is entitled to fair and reasonable compensation for injuries caused by a motor vehicle crash or other incident. What constitutes fair and reasonable compensation depends on several factors.

Economic damages include incurred medical expenses (past and future), lost earnings, and diminished earning capacity.

Non-economic damages include the nature, extent, and duration of the injury, pain and suffering, emotional distress, and loss of enjoyment of life.

There are also several factors outside the standard jury instructions that can strengthen or weaken your position in settlement negotiations. These include how severe the crash was, the type of crash involved, how well the injured party presents as a witness and how sympathetic or unsympathetic they are perceived, and whether the at-fault party was under the influence of alcohol or drugs at the time of the incident.

Venue also plays a role, as some jurisdictions have a history of higher or lower jury verdicts for the same type of loss.

Ultimately, there are a lot of moving parts that are part of the evaluation process. What drives whether a settlement occurs comes down to how much the insurance company is willing to pay and how much the injured party is willing to accept.

I was referred to Paul Ticen from another highly reputable attorney in the Phoenix area and was happy to find someone to take my personal injury case as I had not had any experience working with an attorney before. I worked closely with Paul as he provided expert legal assistance, care, and support to me and my case. I was so grateful to have him as an attorney to answer any questions I had about the process, to reassure me along the way, and to negotiate a settlement on my behalf. I’m so pleased with the outcome of my case and would 100% recommend Paul Ticen for personal injury cases.

The legal system is intimidating and overwhelming to navigate, and I’d managed to make it through adulthood without needing an attorney until 2023. Thankfully, I came across Paul Ticen. Paul is a grounded, down to earth professional that cares deeply about his clients. He’s honest, compassionate, communicative, transparent, responsive, and always makes himself available for questions, assistance, and support once he represents you. He eased my nerves and did a wonderful job explaining the each step through the legal system for me as a novice. He gets to know about you as a human being, your life, interests, and family from a very sincere place. I had wobbly knees and unsure footing when my case began. He offered me his arm to steady me through a complicated case in a territory completely unfamiliar to me so that I never felt alone. Paul’s empathetic nature pairs perfectly with his intelligence and passion for justice/fairness. He will fight for you as his client and look at everything from every possible angle to ensure he is bringing the best possible case forward on your behalf. He’s honest to his core and is extremely trustworthy. He’s extremely knowledgeable and takes research seriously when the need arises. If there’s something he wants to know, he‘ll always find the answer. It was an absolutely pleasure to work with Paul over the 2.5 years he worked on my case. I’m so grateful for all his work and the final outcome for my case. If you’re looking for a fabulous attorney and sincerely great person to represent you, I can’t recommend him enough.

Paul was the best attorney I could have had to handle my personal accident case as it involved working with Medicare and the other person's auto insurance which was was very challenging and tedious. Because none of the medical providers would bill the auto insurance company for any care they provided, they billed Medicare for reimbursement but then Paul had to reverse these payments out from Medicare and work with the auto insurance company for their payments. Paul always kept me advised as to the progress of the claims being paid and if there was anything I could do for which I was glad to help. He is a man of high of high integrity and honesty and steered me through this legal process in a calm and professional manner for which I will forever appreciate.

He is very clear with his communication and we valued his transparency throughout our cases.
