Chandler Burn Injury Attorney

Chandler Injury Lawyer Paul Ticen is committed to guiding you through the complexities of Chandler burn injury claims, committed to a positive client experience and committed to client’s receiving fair and reasonable compensation for the physical and emotional devastation that burn injuries can cause.

Why are Burn Injuries so Painful?

Burn injuries occur when heat, extreme cold (frostbite), chemicals, electricity, radiation, friction, or abrasion damages the skin and underlying tissue. Burns are among the most painful and debilitating injuries someone can experience.  The burn injury itself is painful because of the damaged tissue and the exposed nerve endings.  The body’s immune response causes significant inflammation and swelling, making even slight touches excruciating. As burns heal, scar tissue forms, reducing skin elasticity. If a burn covers a joint, the resulting tightness can severely limit range of motion.  Over time, scar tissue can also pull on surrounding healthy skin, further restricting mobility and comfort.

Burn Injury Emergency Care

Serious burns require immediate care at a specialized burn center. In Chandler, the East Valley, and the Phoenix metropolitan area, this typically means treatment at the Arizona Burn Center. Emergency care includes surgery, wound cleaning (debridement), medication, and sterile dressings to prevent infection. Immediate professional intervention significantly reduces the risk of complications, infections, and long-term damage.

Long-Term Consequences of Burn Injuries

Burn injuries often have lasting physical, functional, and emotional impacts, including:

Permanent Scarring

Burn injuries frequently result in permanent scarring. Depending on the burn’s location and severity, scars can significantly alter appearance, cause discomfort, and impact emotional well-being. These scars can also be sensitive to temperature changes and sun exposure, requiring ongoing care and precautions.

Contractures

Contractures occur when scar tissue tightens, pulling on surrounding skin and tissue. Contractures often limit joint movement, significantly reducing mobility and functional abilities. In severe cases, surgical intervention may be necessary to release tightened tissue and restore some function.

Chronic Pain and Altered Sensation

Nerve damage caused by burns can result in ongoing pain, itching, numbness, or “pins-and-needles” sensations long after the initial injury has healed. Chronic pain management becomes a critical aspect of long-term recovery, often involving multidisciplinary approaches including medication, physical therapy, and psychological counseling.

Functional Impairments

Severe burns and the resulting treatments, such as skin grafts, can significantly impair normal daily activities like walking, lifting, and fine motor skills. Even seemingly simple tasks may require extensive rehabilitation to regain functional independence, impacting quality of life and employment opportunities.

Emotional Trauma

The extensive physical impact and visible scarring from burns can lead to significant emotional trauma, including anxiety, depression, and diminished self-esteem. Psychological counseling and emotional support are essential components of holistic recovery, addressing the profound mental health implications of severe burn injuries.

Increased Skin Cancer Risk

Burn injuries compromise skin integrity, increasing the long-term risk of skin cancers, requiring ongoing vigilance and monitoring. Regular dermatological assessments and preventive measures such as protective clothing and sunscreen become lifelong necessities.

Common Causes of Burn Injuries

Burn injuries commonly result from:

  • Thermal Burns: Flames from house or vehicle fires, hot liquids or steam (scalding), hot surfaces (engines, radiators), or extreme cold exposure (cryotherapy tanks).
  • Chemical Burns: Exposure to acidic or alkaline chemicals in industrial, residential, or commercial settings.
  • Electrical Burns: Contact with live electrical equipment or electrical arcing from faulty wiring and equipment.
  • Radiation Burns: UV exposure (sunburn, tanning beds), medical radiation treatments, and occupational exposures.
  • Friction/Abrasion Burns: “Road rash” from vehicle crashes, bicycle accidents, or falls on rough surfaces such as asphalt or artificial turf.

Classifying Burn Severity

Burn severity is classified by depth, extent, and location:

First-degree burns/Superficial: Epidermis (outer skin layer), resulting in redness and pain.

Second-degree burns/Partial-Thickness: Epidermis and part of the dermis, causing blisters and significant pain.

Third-degree burns/Full-Thickness: Entire epidermis and dermis layers, appearing charred or leathery, often painless initially due to nerve destruction.

Fourth-degree burns/Deep Full-Thickness: Extends into muscles, bones, and connective tissues, often requiring extensive surgery and rehabilitation.

Additionally, burn location and the total body surface area affected both significantly influence the complexity of required care and potential outcomes.

Fair and Reasonable Compensation You May Be Entitled To

Based on the nature, extent and duration of the burn injury:

  • Reasonable expenses of necessary medical care, treatment and services (past and future)
  • Lost income and reduced earning capacity
  • Rehabilitation and home-care expenses
  • Pain and suffering (past and future)
  • Emotional distress/anxiety (past and future),
  • Loss of enjoyment of life (past and future)
  • Permanent impairment, disability or disfigurement

Establishing Fault in Burn Injury Cases

Pursuing a negligence claim for a burn injury requires a finding of fault, damages (the burn injury) and causation (conduct that was a substantial factor in causing the burn injury). Fault requires the existence of a duty to conform to a particular standard of care and a showing that the standard of care was breached. The default standard is reasonable care and a breach occurs when there is a failure to act as a reasonably prudent person would under similar circumstances.

A duty of reasonable care is created when a person’s actions create a risk of physical harm to harm. For example, operating a motor vehicle on Arizona’s roadways and freeways. A duty of care can also be created by statute, common law, status (e.g. licensee or invitee) and relationship (e.g. school and student) and by contract. Under certain circumstances, the standard of reasonable care is lowered. In Arizona, a landowner owes a trespasser a duty of care only to refrain from willfully or intentionally inflicting injury to the trespasser.

In some burn injury cases, showing fault and causation will be relatively easy such as a clear-cut at-fault motor vehicle crash that results in a vehicle fire. Others will be significantly more difficult.

The legal system is intimidating and overwhelming to navigate, and I’d managed to make it through adulthood without needing an attorney until 2023. Thankfully, I came across Paul Ticen. Paul is a grounded, down to earth professional that cares deeply about his clients. He’s honest, compassionate, communicative, transparent, responsive, and always makes himself available for questions, assistance, and support once he represents you. He eased my nerves and did a wonderful job explaining the each step through the legal system for me as a novice. He gets to know about you as a human being, your life, interests, and family from a very sincere place. I had wobbly knees and unsure footing when my case began. He offered me his arm to steady me through a complicated case in a territory completely unfamiliar to me so that I never felt alone. Paul’s empathetic nature pairs perfectly with his intelligence and passion for justice/fairness. He will fight for you as his client and look at everything from every possible angle to ensure he is bringing the best possible case forward on your behalf. He’s honest to his core and is extremely trustworthy. He’s extremely knowledgeable and takes research seriously when the need arises. If there’s something he wants to know, he‘ll always find the answer. It was an absolutely pleasure to work with Paul over the 2.5 years he worked on my case. I’m so grateful for all his work and the final outcome for my case. If you’re looking for a fabulous attorney and sincerely great person to represent you, I can’t recommend him enough.

Paul was the best attorney I could have had to handle my personal accident case as it involved working with Medicare and the other person's auto insurance which was was very challenging and tedious. Because none of the medical providers would bill the auto insurance company for any care they provided, they billed Medicare for reimbursement but then Paul had to reverse these payments out from Medicare and work with the auto insurance company for their payments. Paul always kept me advised as to the progress of the claims being paid and if there was anything I could do for which I was glad to help. He is a man of high of high integrity and honesty and steered me through this legal process in a calm and professional manner for which I will forever appreciate.

We hired Paul to assist with our Trademark infringement case. He was extremely helpful and knowledgeable with our situation. He helped resolve the issue and was able to settle the issue without having to take it to trial. We would not have resolved the issue with out his assistance. I highly recommend him and would definitely rehire him if we ever need an attorney again.
